Youth Clinic Terms & Conditions

Code of Conduct: Participants must adhere to camp rules and show respect for coaches, staff, and other players. The camp reserves the right to dismiss any participant for behavior issues without a refund.

Media Consent: By participating, you grant the camp permission to use photos or videos of your child for promotional purposes.

Participant Release of Liability, Waiver of Claims, and

Authorization of Medical Care

I am the parent or legal guardian of the child (“Youth”) identified during this registration to participate in one or more programs (“Programs” and each a “Program”) offered by Florida Elite Soccer Academy, Inc., a Florida not for profit corporation (“Florida Elite”), and wish for Youth to participate in such Programs. I understand and have explained to Youth that participation in a Program involves dangers or conditions, known or unknown, which are characteristic of, intrinsic to, or an integral part of the activities involved in the Programs and which are not eliminated even if the Florida Elite acts with due care in a reasonably prudent manner (each, an “Inherent Risk” and together “Inherent Risks”), which Inherent Risks include, but are not limited to (a) the failure by Florida Elite to warn Youth or Youth’s natural guardian of an Inherent Risk and (b) the risk that Youth or another participant in the activities involved in the Programs may act in a negligent or intentional manner and contribute to the injury or death of Youth. On behalf of Youth, myself, and any other person who may claim through or on behalf of Youth (collectively, “Participant Parties”), Youth and I assume all Inherent Risks incidental to, or pertaining in any way to the activities involved in participating in a Program, including, without limitation, Inherent Risks that may result in property damage, mental, physical, emotional, and bodily injuries, and/or death.

In consideration for Youth’s participation in one or more Programs, I, on behalf of all Participant Parties and each of our respective heirs, successors and assigns, agree to, and do hereby, discharge, release and waive any claims, damages, lawsuits, and/or causes of action (together, “Claims”) against Florida Elite, and its respective directors, officers, owners, landlords (and any other owners of the property, land or facilities on which Florida Elite operates or any Program is conducted), affiliates, employees and agents, resulting from an Inherent Risk in the activities involved in the Programs, including Claims for personal injury, death, or property loss or damage. I further covenant not to sue Florida Elite for any Claim released under this Release of Liability, Waiver of Claims and Authorization of Medical Care, and agree to indemnify, defend and hold harmless (including payment of reasonable attorneys’ fees, costs, and insurance deductibles) the Florida Elite with respect to any such Claims.

In addition to the foregoing, I, on behalf of all Participant Parties, hereby request and a grant permission to Florida Elite to authorize emergency medical treatment for Youth (including through an athletic trainer, coach, emergency medical technician, nurse, medical treatment facility, and/or doctor of medicine or dentistry and any personnel associated with the foregoing), if necessary, and I assume personal and financial responsibility for any medical care and treatment that Youth may require as a result of volunteering and participating in the Programs. I also authorize emergency transportation of Youth to a medical treatment facility should an individual listed above consider it to be warranted. The Participant Parties agree to indemnify the Releases from any Claim based on such transportation or other medical care.

I understand that this Participant Release of Liability, Waiver of Claims, and Authorization of Medical Care is a contract between the Participant Parties and Florida Elite. I sign it of my own free will. I also understand that this contract is severable and if any part of it is held by a court of law to be unenforceable, the rest shall survive.

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF FLORIDA ELITE USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM FLORIDA ELITE IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND FLORIDA ELITE HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

By checking the “I agree” box, I represent and warrant that I am the parent or legal guardian of Youth and intend, on behalf of Youth, myself and each other Participant Party, to electronically sign and be bound by this Participant Release of Liability, Waiver of Claims, and Authorization of Medical Care.
